These Digital Device Terms and Conditions (the "Agreement") set forth the terms and conditions governing the use of digital devices provided by [HK ELEPHONE COMMUNICATION TECH CO.,LIMITED ] (referred to as "Provider" or "we") to the user (referred to as "User" or "you"). By using the digital device, you agree to be bound by the terms and conditions outlined in this Agreement.

1.Device Ownership and Use:

  • The digital device provided remains the property of the Provider.
  • The device is intended solely for your personal use and must not be transferred, sold, or assigned to any third party without prior written consent from the Provider.
2.Acceptable Use:
  • You are responsible for using the digital device in compliance with all applicable laws, regulations, and this Agreement.
  • You agree not to use the device for any unlawful, fraudulent, or malicious purposes.
  • You shall not modify, disassemble, reverse engineer, or attempt to gain unauthorized access to the device's software or hardware.
3.Software and Updates:
    • The digital device may come pre-loaded with software and applications.
    • You acknowledge that the Provider retains all rights, title, and interest in the software and applications.
    • The Provider may periodically provide software updates or upgrades, which you are encouraged to install to ensure optimal performance and security.
    4.Data and Privacy:
      • The Provider may collect and process personal information as outlined in the Privacy Policy.
      • You understand and consent to the collection, storage, and use of your personal information in accordance with applicable laws and the Provider's Privacy Policy.
      5.Limitation of Liability:
        • The Provider shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use the digital device.
        • The Provider makes no warranties or representations, express or implied, regarding the device's performance, functionality, or fitness for a particular purpose.
        6.Indemnification:
          • You agree to indemnify and hold the Provider harmless from any claims, damages, losses, or expenses arising out of your use of the digital device or any breach of this Agreement.
          7.Termination:
            • The Provider may terminate this Agreement and reclaim the digital device at any time without prior notice if you violate any terms outlined herein.
            • Upon termination, you must immediately cease using the device and return it to the Provider in its original condition.
            8.Governing Law:
              • This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where the Provider is located, without regard to its conflict of law principles.
              9.Entire Agreement:
              • This Agreement constitutes the entire agreement between you and the Provider concerning the use of the digital device and supersedes any prior or contemporaneous agreements, communications, or representations.
              By using the digital device, you acknowledge that you have read, understood, and agreed to be bound by the terms and conditions of this Agreement. If you do not agree with any provisions of this Agreement, you must discontinue the use of the digital device.
